Attorney Stephen Pfaff has successfully defended a state discrimination charge brought by a former correctional officer against the Essex County Sheriff’s Department.
The former correctional officer alleged that he had been constructively discharged, despite evidence indicating that he had formally resigned via written letter. The plaintiff alleged that he had been discriminated against pursuant to c. 151B Section 9 due to the department’s gathering of information about the plaintiff’s involvement with the local police department directly from him, rather than a third party.
At the close of the plaintiff’s evidence, Attorney Pfaff moved for a direct verdict, and the motion was granted, dismissing the case.
